TOUR TERMS AND CONDITIONS – RELEASE OF LIABILITY
I have read and agree to the following terms and conditions:
Tour Reservations and Payments Policy: A deposit of $500 per person is required
within seven days of receipt of your signed reservation form to confirm your
reservation on a Tour. Your final payment is due no later than 60 days prior to the
tour departure. TWO LANE TOURS reserves the right to cancel your booking and apply
cancellation charges as indicated herein should payments not be received within the
specified periods. All payments must be made in U.S. dollars. Cancellations and
Refunds Policy: All requests for cancellation must be received in writing. Depending
on when you cancel your tour, charges will be assessed as follows:
1) An administrative charge of $100 when canceled 90 or more days prior to tour
departure.
2) The deposited amount when canceled 89-60 days prior to tour departure.
3) 100% of full tour cost when canceled less than 60 days prior to tour departure.
No allowance or refund can be made for any accommodations, excursions or portions
of the tour in which you do not participate, regardless of reason. We strongly
recommend trip cancellation insurance.
Responsibilities: We believe it is our responsibility to properly arrange and conduct
your tour. However, TWO LANE TOURS, its subsidiaries and/or associated agents and
companies shall not be held responsible for and shall accept no liability in respect of
any claims, losses, damages, costs or expenses arising out of:
a) personal injury, sickness, disease, accident or death, however caused,
including without limitations, while engaged on, or by reason of, any TWO LANE TOURS
tour whether due to ownership, maintenance, use, operation or control of any
motorcycle, automobile, vehicle, hotel, common carrier, or any other conveyance used
in the tour;
b) loss or damage to or delay of baggage or other property unless resulting from
TWO LANE TOURS’ negligence in which case TWO LANE TOURS liability shall be limited
to the actual loss but in no event would exceed the total tour cost;
c) failure, delay or other irregularity, acts or omissions and loss resulting there
from occurring during a TWO LANE TOURS tour due to actions of hoteliers, carriers and
other independent suppliers, or due to government action, weather, mechanical
breakdown, equipment failure, labor disputes, sickness, acts of war, insurrection,
terrorism, Acts of God or any other causes beyond TWO LANE TOURS’ direct control.
TWO LANE TOURS reserves the right to cancel or change any tour in accordance with
operating requirements or circumstances. Should cancellation or change of tour prove
necessary, we will offer you the choice of an alternate tour date or a full refund. TWO
LANE TOURS constantly strives to improve tour itineraries and features. If such
improvements can be made, or unforeseen circumstances beyond our control make
changes necessary, we reserve the right to vary itineraries and to substitute hotels
and routes. TWO LANE TOURS is not responsible for any other travel arrangements
affected due to tour cancellations or changes.
A limited number of single rooms are available at extra cost (single mark-up) on a first
come, first served basis, but availability cannot be guaranteed. TWO LANE TOURS will
attempt to find a roommate for riders not specifying single room on their registration
form, but cannot guarantee it; surcharge for single room may be applied.
Photos and videos produced by TWO LANE TOURS or its representatives on tour are
the property of TWO LANE TOURS. The copyrights rest with TWO LANE TOURS. TWO
LANE TOURS can use all of this material for advertising and marketing purposes,
including images in which individual tour members can be recognized, without any
charge from the tour member arising for TWO LANE TOURS for this use of material.
TWO LANE TOURS strongly recommends that a safety helmet be worn while operating
or riding on motorcycles. TWO LANE TOURS expressly prohibits tour participants from
consuming alcohol or taking illegal drugs while operating any tour motorcycle.
Furthermore, anyone found to have consumed alcohol or taken illegal drugs
immediately prior to, or during the course of, any day’s ride will be prohibited from
riding for the remainder of the tour. TWO LANE TOURS reserves the right to decline to
accept or retain any person as a tour participant at any time. Under no circumstances
can TWO LANE TOURS be held responsible for snow, rain or other weather conditions,
nor can any tour participation be canceled or amended by you at any time on the basis
of rain, snow or other weather conditions. If your tour motorcycle becomes inoperable
due to mechanical failure, and said mechanical failure cannot be resolved quickly, tour
itinerary will be provided to assist with continued participation in an attempt to rejoin
the group. TWO LANE TOURS will not be liable for tour interruptions, missed
reservations or other expenses incurred as a result of any motorcycle breakdown.
Fares quoted in this brochure are those in effect at time of printing. If cost factors,
including but not limited to, hotels, entry fees, etc. dictate the need for fare increases,
TWO LANE TOURS may do so at any time prior to 60 days before tour departure.
TWO LANE TOURS reserves the right to correct printing errors or calculation mistakes
at any time.
Waiver Agreement: My payment of a deposit and my signature on this form
constitutes my acceptance and understanding of the terms, conditions, and
information contained herein. I further understand and accept that the TWO LANE
TOURS tour and its activities involve risk of personal injury or death and damage to or
loss of property. In consideration of the benefits to be derived from my participation in
this tour, I hereby accept all risks of personal injury and property damage arising from
my participation in this tour and I hereby agree that I, my dependents, heirs,
executors and assigns do release and hold harmless TWO LANE TOURS and its
employees, owners, directors, trustees and representatives from any and all claims,
including claims of illness, bodily injury, death or property damage or loss, however
caused, arising from or related to this TWO LANE TOURS tour. Further, by signing this
form I certify that I do not have any physical, mental or other condition or disability
that would create a hazard for me or any other tour participants. I also certify that if
an operator I am in possession of a current and valid state required motorcycle
operator’s license. I understand that I will wear a safety helmet and other protective
gear if required by law, and if not, the choice of wearing a safety helmet and other
protective gear is solely my own. I have carefully read these terms and conditions and
this waiver agreement, and I agree to abide by TWO LANE TOURS vacation tours
terms, policies, and conditions as stated herein or elsewhere published by TWO LANE
TOURS.
